This privacy policy (this "Policy") explains how personal information is collected, used, and disclosed by ReserveKing LLC. ("ReserveKing" or "we"). This Policy applies to consumer users (individually referred to as "you") of ReserveKing's webplatform, applications, and other online services (collectively, our "Platform")

Other third parties, such as fitness providersat which you make reservations through our Platform, fitness providers that you pay through our Platform, and social networks that you use in connection with our Platform, may also collect, use, and share information about you. This Policy does not cover such third parties or their services. For information about third-party privacy practices, please consult with them directly.

Information We Collect

We collect information about you in various ways when you use our Platform. We use this information to, among other things, provide the functionality and improve the quality of our Platform and personalize your experience. For example, we may collect your name, email address, postal address, phone number (including your mobile phone number), billing information, survey responses, demographics, primary city, current and prior fitness reservation details, favorite fitness activity, special fitness requests, contact information of people you add to, or notify of, your fitness reservations through our Platform, names, and other information you provide on our Platform. If you use our mobile application, we may also collect your mobile device ID, your precise location data, and the fitness search locations you select. For certain services on our Platform, credit or debit card account information may be required, as further described in the section called "Payment Card Information" below. We may also obtain information from other sources, such as third-party web platform, applications, and services (each, a "Third-Party Platform"), through which you connect with our Platform and combine that with information we collect on our Platform.

When you visit our Platform, some information is automatically collected. For example, when you visit our Platform, we may automatically collect your location, computer operating system, Internet Protocol (IP) address, access times, browser type and language, and the website you visited before our Platform. We also collect information about your usage and activity on our Platform using certain technologies, such as Cookies, Web Beacons and other technologies.

How We Use Information We Collect

We use personal information collected through our Platform for the purposes described in this Policy or disclosed to you on our Platform or otherwise in connection with our services. For example, we may use your information to:

• make and change your fitness reservations made through our Platform;
• offer you, or provide you with, products and services, and the option to pay your bill through our Site;
• operate and improve our Platform, products, and services;
• understand you and your preferences to enhance, personalize, and customize your experience and enjoyment using our Site, products, and services, such as understanding your fitness history to make recommendations about fitness activities you may like;
• display relevant advertising;
• respond to your comments and questions and provide customer service;
• send you information relating to our products and services, including reservation confirmations, receipts, technical notices, updates, security alerts, and support and administrative messages;
• communicate with you about contests, offers, promotions, rewards, upcoming events, and other news about products and services offered by ReserveKing, our subsidiaries, and affiliates; and our selected partners;
• link or combine with other personal information we get from third parties to help understand your needs and provide you with better service;
• authenticate your credit or debit card account information; and
• protect, investigate, and deter against fraudulent, unauthorized, or illegal activity.

By providing your mobile phone number, you expressly consent to receive direct dial calls, autodialed and prerecorded message calls, and text messages from us relating to our product and services at that number.

ReserveKing may store and process personal information in the United States and other countries.

How We Share Information

Information Shared

When you make a fitness reservation through our Platform, your information is provided to us and to the fitness providerswith whom you choose to reserve. In order to facilitate your reservation, your information is provided to that fitness provider, just as it would if you made a reservation by calling the fitness provider, emailing the fitness provider, or using the fitness provider's website. If you provide a mobile phone number, fitness providersmay send you text messages regarding your reservation. Allfitness providersalso require you to provide credit or debit card account information to secure your reservation. When you make a fitness reservation through our Platform and make a payment to a fitness provider through our Platform, we may also share with the fitness providers'additional information, such as information about your fitness preferences and history or information that we collect via Third-Party Platforms. You also have the option of indicating special preferences or providing comments about your reservation that ReserveKing will pass on to that fitness provider.

We may share with fitness providerssummary reports of feedback from customers. If you provide comments about a fitness activity through our Platform, these comments may be shared with that fitness provider. We will not tie your comments with other information that can identify you, but a fitnessprovider may be able to tell who you are from your comments, particularly if you give your name in the comments or provide contact information, such as an email address.

Information you choose to share with a fitnessprovider when you make a reservation and pay through our Platform may be used by the fitness provider for its own purposes. ReserveKing does not control, and is not responsible for, the privacy practices of fitness providers. Please contact the fitnessprovider directly if you want to learn about its privacy practices.

Payment Card Information

To use certain services on our Platform, such as to make reservations; to make payments to; and to purchase ReserveKing Gift Cards, or other products or services, we require credit or debit card account information. By submitting your credit or debit card account information through our Platform, you expressly consent to the sharing of your information with fitness providers, third-party payment processors, and other third-party service providers (including but not limited to vendors who provide fraud detection services to us and other third parties), and you further agree to the following terms.

• When you use a credit or debit card to secure a reservation through our Platform, we provide your credit or debit card account information (including card number and expiration date, but excluding the CVV number) to our third-party payment service providers and the applicable fitness.
• When you initially provide your credit or debit card account information through our Platform in order to use our fitness payment services, we provide your credit or debit card account information to our third-party payment service providers. As explained in the ReserveKing Terms of Use, these third parties may store your credit or debit card account information so you can use our fitness payment services through our Platform in the future.
• If you purchase ReserveKing Gift Cards, we collect the credit or debit card account information from you. We share this information with our third-party payment service providers in order to process your payments. These third parties may also store your credit or debit card information, other than your CVV number, for your future use on our Platform. Your CVV number will not be stored and must be re-entered for each order.
• For information about the security of your credit or debit card account information, see Section called "Security of Your Personal Information" below.

Information You Share Socially

Our Platform may allow you to connect and share your actions, comments, content, and information publicly or with friends. Our Platform may also allow you to connect with us on, share on, and use Third-Party Platforms, including those on which ReserveKing has a presence.

Please be mindful of your personal privacy needs and the privacy needs of others as you choose whom to connect with and what to share and make public. We cannot control the privacy or security of information you choose to make public or share with others. ReserveKing also does not control the privacy practices of Third-Party Platforms. Please contact those platform and services directly if you want to learn about their privacy practices.

Sharing with Others

We do not share your personal information with third parties other than as described above and as follows:

• We may share personal information when you authorize us to share your information with other third parties (such as the fitness providersat which you make reservations through our Platform) for their own marketing purposes, which are subject to the separate privacy policies of such third parties.
• We may share personal information with affiliates, third-party vendors, consultants, and other service providers who work for us. Such third-party vendors may include vendors who provide fraud detection services to us and other third parties.
• We may share your credit or debit card account information with third parties as described in the section called "Payment Card Information" above.
• We may share aggregate statistical data for the improvement of services offered by our Platform.
• We share personal information with third parties who provide services to us, such as data collection, reporting, ad response measurement, and site analytics, as well as assistance with delivery of relevant marketing messages and advertisements. These third parties may view, edit, or set their own cookies. We and our third-party service providers, advertisers, and/or partners may also place web beacons for these third parties. The use of these technologies by these third parties is subject to their own privacy policies and is not covered by this Policy.
• We may disclose your personal information (i) to comply with laws and to respond to lawful requests and legal process, (ii) to protect the rights and property of ReserveKing, our agents and customers, and others, including to enforce our agreements, policies, and terms of use, and (iii) in an emergency to protect the personal safety of ReserveKing, its customers, or any person.
• We may disclose or transfer your personal information to a third party if we sell, transfer, divest, or disclose all or a portion of our business or assets to another company in connection with or during negotiation of any merger, financing, acquisition, bankruptcy, dissolution, transaction, or proceeding.
• We may also share aggregated or de-identified information with third parties in our discretion.

Security Of Your Personal Information

ReserveKing takes reasonable steps to help protect your personal information in an effort to prevent loss, misuse, unauthorized access, disclosure, alteration, and destruction. When your credit or debit card account information is being transmitted to our Platform or through our Platform, it will be protected by encryption technology, such as Secure Sockets Layer (SSL).

To be clear, ReserveKing does not itself store your credit or debit card account information, and we do not have direct control over or responsibility for your credit or debit card account information. Our contracts with third parties that receive your credit or debit card account information require them to keep it secure and confidential.

Nonetheless, we cannot guarantee that transmissions of your credit or debit card account information or personal information will always be secure or that unauthorized third parties will never be able to defeat the security measures taken by ReserveKing or our third-party service providers. We assume no liability or responsibility for disclosure of your information due to errors in transmission, unauthorized third-party access, or other causes beyond our control. You play an important role in keeping your personal information secure. You should not share your user name, password, or other security information for your ReserveKing account with anyone. If we receive instructions using your user name and password, we will consider that you have authorized the instructions.

Your Information Choices And Changes

You may opt out of receiving promotional emails from ReserveKing by following the instructions in those emails. If you opt out, we may still send you non-promotional emails, such as emails about your ReserveKing account or our ongoing business relations. You may also send requests about your contact preferences or changes to your information, including requests to opt out of sharing your personal information with third parties, to our contact information below.

Application location choices: Most mobile devices allow you to turn off location services. For more information about how to do this, please contact your mobile service carrier or your device manufacturer. If you choose to turn off location services, this could affect certain features or services of our Platform

Cookies

We, and third parties with whom we partner, may use cookies, web beacons, tags, scripts, local shared objects such as HTML5 and Flash (sometimes called "flash cookies"), advertising identifiers (including mobile identifiers such as Apple's IDFA or Google's Advertising ID) and similar technology ("Cookies") in connection with your use of the Service, third party websites, and mobile applications. Cookies may have unique identifiers, and reside, among other places, on your computer or mobile device, in emails we send to you, and on our web pages. Cookies may transmit information about you and your use of the Service, such as your browser type, search preferences, IP address, data relating to advertisements that have been displayed to you or that you have clicked on, and the date and time of your use. Cookies may be persistent or stored only during an individual session.

Third Parties

Third parties may receive information about you as follows:

Advertisers: We may allow third parties to use Cookies through the Service to collect the same type of information for the same purposes as ReserveKing does for itself. In doing so, ReserveKing adheres to the Digital Advertising Alliance's Self-Regulatory Principles for Online Behavioral Advertising. Third parties may be able to associate the information they collect with other information they have about you from other sources. We do not necessarily have access to or control over the Cookies they use, but you may be able to opt out of some of their practices by visiting the following links: Network Advertising Initiative, Omniture, Digital Advertising Alliance and PrivacyChoice. Please note that opting out does not prevent the display of all advertisements to you. Additionally, we may share non-personally identifiable information from or about you with third parties, such as location data, advertising identifiers, or a cryptographic hash of a common account identifier (such as an email address), to facilitate the display of targeted advertising. You may be able to limit our sharing of some of this information through your mobile device settings, as described in the preceding section.

Service Providers: We may rely on third party providers to support or provide some of the services that are available through the Service, such as reservations. We may also rely on third party providers to perform certain services for us in connection with your use of the Service, such as communications and hosting services, network security, technical and customer support, tracking and reporting functions, quality assurance testing, payment processing, our own marketing of the Service, and other functions. We may share information from or about you with these third party providers so that they can perform their services or complete your requests. These third party providers may share information with us that they obtain from or about you in connection with providing their services or completing your requests. Third party providers may also share this information with their subsidiaries, joint ventures, or other companies under common control. Some of our web pages utilize framing techniques to serve content to you from our third party providers, while preserving the look and feel of the service. In such cases, please note that the information you provide is being provided to the third party.

1. Aggregate Information: We may share user information in the aggregate with third parties, such as advertisers and content distributors. For example, we may disclose the number of users that have been exposed to, or clicked on, advertisements.
2. Business Transfers: We may share information from or about you with our parent companies, subsidiaries, joint ventures, or other companies under common control, in which case we will require them to honor this Privacy Policy. If another company acquires ReserveKingor all or substantially all of our assets, that company will possess the same information, and will assume the rights and obligations with respect to that information as described in this Privacy Policy.
3. Businesses on ReserveKing: We may share information from or about you (such as your age and gender), your devices, and your use of the Service (such as which businesses you bookmark or call) with businesses listed on ReserveKing. You may adjust your settings to increase or decrease the amount of information we share. Keep in mind that businesses may see your Public Content and receive informationabout your transactions with them, regardless of your settings. Additionally, if you make a phone call to a business through or in connection with your use of the Platform, we may share information about your call with the business that the business would have received had you called them directly, such as the date and time of your call and your phone number. You may be able to limit our ability to collect and share your phone number through your phone's settings or phone service provider.
4. Investigations: We may investigate and disclose information from or about you if we have a good faith belief that such investigation or disclosure (a) is reasonably necessary to comply with legal process and law enforcement instructions and orders, such as a search warrant, subpoena, statute, judicial proceeding, or other legal process served on us; (b) is helpful to prevent, investigate, or identify possible wrongdoing in connection with the Service; or (c) protects our rights, reputation, property, or that of our users, affiliates, or the public, such as disclosures in connection with our Consumer Alerts program. If you flag or otherwise complain about content through the Platform, we may share the substance of your complaint with the contributor of that content in order to provide an opportunity for the contributor to respond.
5. Links: The Platform may contain links to unaffiliated third party services. Except as set forth herein, we do not share your personal information with them, and are not responsible for their privacy practices. We suggest you read the privacy policies on or applicable to all such third party services.
6. Third Party Accounts: If you sign up for ReserveKing using a third party service like Facebook, or link your ReserveKing account to your account with a third party service like Facebook or Google, we may receive information about you from such third party service.

California Privacy Rights (As Provided by California Civil Code Section 1798.83)

A California resident who has provided personal information to a business with whom he/she has established a business relationship for personal, family, or household purposes (a "California Customer") may request information about whether the business has disclosed personal information to any third parties for the third parties' direct marketing purposes, subject to certain exceptions. In general, again, subject to certain exceptions, if the business has made such a disclosure of personal information, upon receipt of a request by a California Customer, the business is required to provide a list of all third parties to whom it disclosed personal information in the preceding calendar year, as well as a list of the categories of personal information that were disclosed. One of the exceptions allows ReserveKing to provide California Customers a cost-free means to opt out of these disclosures instead of providing such list. Any customer may request to opt out of these disclosures by contacting ReserveKing as described above. California Customers may also request further information about our compliance with this law by contacting us at our address above.

Changes To This Policy

ReserveKing may update or revise this Policy from time to time. You agree that you will review this Policy periodically. If we make any changes to this Policy, we will change the "Last Updated" date above. You are free to decide whether or not to accept a modified version of this Policy, but accepting this Policy, as modified, is required for you to continue using our Platform. If you do not agree to the terms of this Policy or any modified version of this Policy, your sole recourse is to terminate your use of our Platform.
